We are the responsible party / data controller for your personal information.

2. What Personal Information We Collect - Very Tight & Minimal

We only collect information necessary to connect cargo owners with verified truck drivers and to provide freight brokerage services. We do NOT collect unnecessary data.

A. Information You Give Us Directly:

• Contact Form / Quote Request: Full name, email address, phone number, company name, cargo details (weight, type, from/to), message.
• Cargo Owners: Name, surname, company, ID / passport (for verification if needed), phone, email, physical address, cargo description, pickup/delivery addresses.
• Truck Owners / Carriers: Name, surname, ID number, phone, email, physical address, driver's license, PrDP, vehicle registration, vehicle disc, roadworthy certificate, insurance documents (goods in transit, third party), bank details (for verification only, if needed for direct payment facilitation - we do not hold funds).
• Communication: Records of calls, WhatsApp messages, emails to Wesley +27 79 441 2197.

B. Information Collected Automatically (Website):

• IP address, browser type, device type, pages visited, time spent, referral source (via cookies - see Section 8).
• We use basic analytics to improve our service - not to track you personally.

We DO NOT collect: Credit card details (payment is direct between cargo owner and carrier), passwords, biometric data, racial, political, religious beliefs, sexual orientation.

3. How We Use Your Information - Purpose Limitation

We use your information only for specific, lawful purposes:

• To Connect: Match cargo owners with nearest verified truck owners/drivers in our marketplace.
• To Verify: Verify truck owner identity, license, PrDP, vehicle roadworthiness, insurance - to ensure safety and trust for cargo owners.
• To Quote & Coordinate: Provide free quotes, coordinate pickup/delivery times, share load alerts via WhatsApp/SMS.
• To Communicate: Reply to inquiries via phone +27 79 441 2197, email Admin@rogumacargobrokers.co.za, WhatsApp.
• To Invoice R300 Platform Fee: For truck owners - monthly R300 platform access fee processing (we may use Paystack / EFT records).
• To Improve: Analyze website usage to improve services.
• To Comply with Law: SARS customs requirements, South African transport laws, POPIA, fraud prevention.

We will never use your data for purposes unrelated to freight brokerage without your consent.

4. Legal Basis for Processing (POPIA Section 11)

• Consent: When you fill contact form, register truck, request quote - you consent.
• Contract: Processing necessary to perform freight brokerage agreement between cargo owner and carrier.
• Legitimate Interest: To operate secure marketplace, prevent fraud, verify identities.
• Legal Obligation: Compliance with SARS, NRTA, POPIA.

5. How We Share Your Information - No Selling Ever

We share only as follows:

• Between Cargo Owner & Verified Carrier: When we match a load, we share necessary contact details (name, phone) and cargo/pickup info between the two parties to enable direct communication and contract. This is our core job.
• Service Providers: Website hosting (Hostinger / Afrihost), email provider, WhatsApp Business API - under strict confidentiality.
• Legal Authorities: If required by South African law, court order, SARS, SAPS, or to prevent fraud/illegal activity (e.g., stolen goods, undeclared hazardous cargo).
• With Your Consent: Any other sharing only with explicit consent.

We do NOT share with advertisers, data brokers, or for marketing unrelated to logistics.

6. Data Security - Powerful Protection

We implement tight security measures:

• SSL/TLS encryption on rogumacargobrokers.co.za
• Access control - only Wesley and authorized staff access data
• Documents (ID, license, insurance) stored securely, not publicly accessible
• WhatsApp and email communications encrypted in transit
• Regular security review of website and hosting
• We do not store bank card details - all payments direct between parties

Despite best efforts, no system is 100% secure. We will notify you and the Information Regulator if a breach occurs as required by POPIA.

7. Data Retention - How Long We Keep

• Active Clients / Carriers: While you are active plus 5 years for legal/tax records (per SA law).
• Inquiries not converted: 12 months, then deleted.
• Verification Docs (Truck Owners): While registered + 1 year after de-listing, unless law requires longer.
• Website logs: 12 months.

After retention period, data is securely deleted or de-identified.

8. Cookies & Tracking

Our website uses minimal cookies:

• Necessary Cookies: To make site work (e.g., session).
• Analytics Cookies (Optional): Google Analytics / Meta Pixel to understand traffic - anonymized. You can disable in browser.

We do NOT use invasive tracking, fingerprinting, or sell cookie data. By using site, you consent to necessary cookies. You can opt-out of analytics via browser settings.

9. Your Rights Under POPIA - You Are in Control

Under POPIA, you have the right to:

• Right to Access: Request what personal info we hold about you.
• Right to Correction: Request correction of inaccurate info.
• Right to Deletion: Request deletion (where no legal retention required).
• Right to Object: Object to processing for certain purposes.
• Right to Withdraw Consent: Withdraw consent anytime (does not affect prior lawful processing).
• Right to Complain: Lodge complaint with Information Regulator South Africa (https://inforegulator.org.za) and with us.
• Right to Not Be Subject to Automated Decision Making: We do not use fully automated profiling.

How to Exercise: Email Admin@rogumacargobrokers.co.za with subject "POPIA Request" or call Wesley +27 79 441 2197. We respond within 21 days per POPIA.

10. Children's Privacy

Our services are for businesses and adults (18+). We do not knowingly collect data from children under 18. If you believe a child provided data, contact us immediately for deletion.

11. Third-Party Links

Our website may contain links to Facebook Shop, Google Maps, etc. Their privacy policies apply when you click them. We are not responsible for third-party sites.

12. International Transfers

Data is primarily stored and processed in South Africa. If we use international service providers (e.g., Google, Meta), we ensure adequate protection per POPIA Section 72 via contracts or that provider is POPIA/GDPR compliant.

13. Marketing & WhatsApp Alerts

For Truck Owners: By registering (R300/month), you consent to receive WhatsApp/SMS load alerts for loads near your base. You can opt-out anytime by replying "STOP" or contacting Wesley. For Cargo Owners: We may send quote follow-ups via email/WhatsApp. No spam. You can opt-out anytime.

We do NOT send unrelated marketing without consent.

14. Changes to This Policy

We may update this Privacy Policy to comply with law or improve services. Last updated date at top. We will post updated version on rogumacargobrokers.co.za/privacy.php. Continued use after update means acceptance. For material changes, we will notify via email/website banner.
